The proposal to control only games of skill and exempt games of chance from regulation was rejected by the Prime Minister’s Office.

This implies that any game that generates revenue, including all similar online games, will fall under Indian jurisdiction.

In this context, the administration has solicited input from all relevant parties. To ensure that the regulation of this has no gaps, tax experts’ opinions are also being sought in addition to this.

India’s definition of gaming has generated debate. According to the Supreme Court, some fantasy games like the card game Rummy are both skill-based and acceptable.

The High Courts of various states have simultaneously expressed differing opinions regarding games like poker.

The rules are now being written by the IT Ministry and the Prime Minister’s Office.  The federal government will provide a comprehensive concept of the games, and the state governments will be granted the authority to ban or not.

The future of gambling and games of chance will only be decided by the state governments.
